WARNING: READ CAREFULLY. THIS AGREEMENT CONTAINS BINDING ARBITRATION CLAUSES, WAIVERS OF CLASS ACTION RIGHTS, AND STRICT INTELLECTUAL PROPERTY ENFORCEMENT PROTOCOLS.
By accessing, downloading, installing, or using the SpectroModel application ("App"), website, or any associated services (collectively, the "Service"), the User ("You") hereby acknowledges, accepts, and agrees to be bound by the full extent of this Master Service Agreement ("Agreement"). This Agreement constitutes a legally binding contract between You and SpectroModel ENT. ("Company"). If You do not agree to these terms, You must immediately cease all use of the Service and uninstall the App. This provision implies continuous monitoring and automated enforcement protocols active on the User's account to ensure compliance.
For the purposes of this Agreement and all associated legal documents, the terms "Creator(s)," "creator(s)," "Company," "company," "Owner(s)," "owner(s)," "Employee(s)," "employee(s)," "SpectroModel ENT," "SpectroModel," "spectromodel," "Company's Creator(s)," "company's creator(s)," "Admin," "Head of Leadership," and any other variation in capitalization, spacing, casing, or typographic variation SHALL BE INTERPRETED AS SYNONYMOUS. The intent, authority, and legal weight of the statement remain unchanged regardless of typographic variation. English language ambiguity, semantic multivalency, or philological arguments shall not be exploited to void, nullify, or circumvent these terms. The Creator(s) owns the App and Company and maintains absolute ownership and authority over the platform.
WARNING: READ BEFORE USING. A very small percentage of individuals may experience epileptic seizures, blackouts, or seizure-like symptoms when exposed to certain light patterns, flashing lights, geometric patterns, or strobe effects. Exposure to specific patterns or backgrounds on a computer screen, or while using the SpectroVerse, Visualizer, Video Studio, Screen Share, or Haptic Feedback features, may induce an epileptic seizure in these individuals. Certain conditions may induce previously undetected epileptic symptoms even in persons who have no history of prior seizures or epilepsy. If You, or anyone in Your family, have an epileptic condition, You MUST consult Your physician prior to using the App. Immediate discontinuation of use is advised if You experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.
SpectroModel ENT. and its Creator(s) acknowledge that audio content, lyrical analysis, and visual stimuli analyzed, generated, or viewed within the App may inadvertently trigger psychological responses or recall traumatic memories. The Company does NOT intend to cause trauma, recall traumatizing memories, or provoke mental health episodes. The Company, Founder, Owner(s), and Employee(s) are NOT LIABLE for any instance of trauma, delusion, irrational belief, psychological distress, or mental instability caused by the use of the App or the consumption of content analyzed therein. Users with known mental health concerns, as defined in standard psychology dictionaries or by medical professionals, should consult a guardian, coach, or physician before use.
The Company has implemented accessibility features to accommodate the disabled community, seniors, and those with intellectual or physical disabilities, including high-contrast text modes, screen reader compatibility, and haptic feedback options. However, the Company does not guarantee compatibility with every assistive device, third-party hardware, or screen reader software and cannot be held liable for accessibility limitations inherent to third-party platforms or the User's specific hardware configuration.
SpectroModel maintains a strict privacy-first policy regarding User data. The Company shall only disclose User data to law enforcement when mandated by: (a) valid court order; (b) federal warrant issued by a court of competent jurisdiction; (c) instances of documented harassment, threats, assault, battery, or attack; or (d) instances of confirmed illegal activity, hacking, or severe User data breach. In such specific instances, the Company reserves the right to cooperate with authorities to identify, warn, ban, and pursue legal remedies against the offender. Otherwise, the Company prioritizes User privacy and shall not willingly share, sell, or distribute User information to third parties, government agencies, or regulatory bodies without User consent or legal compulsion.
The User acknowledges and agrees that SpectroModel utilizes a specialized "Cloud-First" architecture designed to maximize privacy and minimize liability. Raw audio files uploaded by the User are NOT permanently stored on SpectroModel servers. The Company employs a volatile memory processing protocol wherein audio files are loaded into Random Access Memory (RAM) solely for the duration of the analysis (typically 30 to 60 seconds). Immediately upon the completion of the requested analysis (e.g., Track Analysis, Rhythm Calculation, or Stem Separation), the audio buffer is irreversibly cleared from the server’s memory. No copy of the raw audio waveform is retained by the Company. Only the resultant analytical data (metadata, JSON results, spectrogram images, and hit scores) is saved to the User’s designated cloud storage account. The Company is not liable for the loss of any raw audio files, as it does not act as a file storage repository.
By accessing, logging into, or utilizing any feature of the App, the User explicitly, irrevocably, and voluntarily consents to the "AI Learns From My Data" protocol. The User understands that all interactions, uploaded metadata, analysis results, and usage patterns may be utilized by the Company to train, refine, recalibrate, and improve the Company’s proprietary Artificial Intelligence (AI) and Machine Learning (ML) algorithms. This data usage is strictly for service improvement, algorithmic weighting adjustments (e.g., refining Hip Hop 80s/90s detection logic), and bias reduction. This mandate does not grant the Company the right to sell personal User data to third-party advertisers, but rather to use anonymized data points for internal technological advancement.
COMPANY OWNS ALL COMPANY'S INTELLECTUAL PROPERTY. SpectroModel ENT., the Creator(s), and the Owner(s) retain exclusive, worldwide, royalty-free, perpetual, and inalienable ownership of the App, its source code, binary executables, object code, and all proprietary algorithms contained therein. This ownership extends to, but is not limited to, the Hip Hop 80s/90s/2000s detection logic, Pop Hit Score calculators, Digital Signal Processing (DSP) engines, "VibeVision™" visualization technology, and all AI training datasets.
No User, person, entity, competitor, or automated agent is permitted to use, steal, replicate, clone, distribute, or reverse engineer the name "SpectroModel," the "SpectroModel" logo, the "VibeVision" trademark, or any associated brand assets without the Owner(s)'s and Creator(s)'s express, written, and notarized consent. Any attempt to decompile the App, analyze its network traffic for the purpose of cloning, or extract the underlying Hit Prediction algorithms constitutes a material breach of this Agreement. The Company reserves the right to pursue all available legal remedies, including injunctive relief and statutory damages, against violators.
This provision implies continuous monitoring and automated enforcement protocols active on the User's account. The App contains security measures designed to detect unauthorized tampering, debugging, or code injection. Triggering these protocols may result in an immediate, non-appealable ban of the User's account, IP address, and hardware ID. The Creator(s)’s authority in defining and enforcing these rights is absolute and non-negotiable.
The User acknowledges that "SpectroModel™", "VibeVision™", and "SpectroVerse™" are legally registered trademarks of SpectroModel ENT. Furthermore, the entire SpectroModel application and its underlying technological frameworks—including the "No-Interference" security protocol, the "Auto-Healing" monitors, the "Zero-Iteration" mastering engines, and the "Agent Deployment" autonomous AI system—are protected under PATENT PENDING status as a unified technological system. Unauthorized use of these terminologies, brand assets, or technological methodologies in any commercial or non-commercial capacity without express written license is strictly prohibited and will be prosecuted to the fullest extent of the law.
The App provides a "Track Analysis" feature that generates a "Hit Prediction" score on a scale of 0 to 10. The User understands and agrees that these scores are the result of mathematical calculations based on audio features such as tempo, energy, and danceability, compared against a historical database of 175 million streaming data points and chart data (e.g., Billboard Hot 100, Spotify Viral 50). A low analysis score does NOT imply that a musical composition is of poor artistic quality, lacks merit, or is "bad". Rather, it indicates that the algorithmic calculations deem the song's acoustic characteristics do not currently align with the specific statistical patterns of mainstream "Pop" hits or high-velocity viral trends found in the training dataset.
The Company explicitly disclaims any bias or prejudice in its algorithmic scoring. The User acknowledges that specific genres, particularly Hip Hop music from the 1980s, 1990s, and 2000s, may utilize production techniques that differ from modern Pop standards. Consequently, a track may score lower on a "Pop" probability scale while remaining a culturally significant or "great" song within urban communities or specific demographic niches. The analysis results mean nothing beyond what the raw data calculations display. The Company asserts that no discrimination, racism, or prejudice is intended by the coding structure, and the Creator(s) reserves the right to remove, amend, or recalibrate these algorithms at the Owner(s)'s discretion to improve accuracy.
The User agrees that analytical outputs, including but not limited to Hit Scores, Market Fit assessments, and Rhythm Analysis graphs, do not constitute defamation, libel, or slander against the User or the artist. These outputs are automated, objective data visualizations and are not subjective critical reviews. The User waives any right to pursue civil litigation against the Company, Creator(s), or Employee(s) based on the perceived reputational damage caused by a low algorithmic score or an unfavorable market analysis.
The "Rhythm Analysis" tool utilizes Digital Signal Processing (DSP) to detect groove patterns, timing offsets, and rhythmic consistency. This feature is provided for educational, creative, and informative purposes only. The User acknowledges that "Groove" is subjective and that the App's detection of "timing errors" may be intentional artistic choices (e.g., "swing" or "human feel"). The Company is not responsible for any production decisions made by the User based on the App’s visual feedback.
The "SpectroVerse" feature allows Users to generate professional 3D virtual environments. Users acknowledge that the SpectroVerse utilizes a Real-Time ML Adaptation Engine that adjusts lighting, crowd behavior, and avatar physics based on audio input and behavioral goals set by the "AI Director". Users are strictly prohibited from creating, uploading, or displaying avatars, scenes, or textures that contain hate speech, nudity, sexually explicit material ("XXX"), illegal symbols, or content that incites violence. The Creator(s) reserves the unilateral right to remove any asset from the SpectroVerse at the Owner(s)'s discretion if it violates these ethical standards. Furthermore, the User consents to the use of their avatar customization data to train the quality optimization algorithms developed by SpectroModel ENT.
The App includes a "Monetization Hub" designed to track potential revenue, manage NFTs, and estimate streaming royalties. The User expressly acknowledges that all financial figures, projected earnings, and "hit potential" revenue forecasts displayed within the App are ESTIMATES ONLY based on historical market data (e.g., Spotify rates at ~$0.004/stream, Apple Music at ~$0.01/stream). The Company does not guarantee specific financial return, profit, or commercial success. The Market sets the price. Actual earnings may vary based on territory and distributor fees. The Company is not a financial advisor.
User payments for premium features, subscription tiers (Basic, Pro, Premium), or specific tools constitute an agreement to access said features for the designated subscription period. ALL PAYMENTS ARE NON-REFUNDABLE except as required by applicable law (including but not limited to consumer protection laws in the European Union, United Kingdom, and other jurisdictions that mandate cooling-off periods or refund rights). Users in the EU have the right to cancel within fourteen (14) days of purchase pursuant to EU Directive 2011/83/EU. To prevent accidental transactions, the App shall present an "Are you sure?" confirmation prompt before any purchase is finalized. The Company adheres to a strict policy of transparency: No undisclosed upgrades, automatic renewals without notice, or hidden fees shall be charged. Users shall receive notice at least seven (7) days before any subscription renewal.
The App incorporates Haptic Feedback Technology enabling Users to send tactile sensations (e.g., "Virtual Hug," "Heartbeat," "Energy Pulse") to other users or devices. Users agree to utilize this feature responsibly and ethically. Sending excessive, unsolicited, or harassing vibration patterns to other users constitutes a violation of the Company's Anti-Harassment Policy. The User acknowledges that haptic patterns run locally on their device and that the Company utilizes Privacy Protected AI Learning to optimize these patterns without storing sensitive biometric data.
The "Sheet Music Library" feature utilizes AI to transcribe audio into musical notation. While the Company strives for high accuracy, the User acknowledges that automated transcription may contain errors, particularly with complex polyrhythms. The generated sheet music is intended for educational and reference purposes. The Company is not liable for any inaccuracies in key detection, chord identification, or rhythmic notation that may arise during the digitization process.
The App provides a suite of lyrical tools, including "Lyrics Retrieval," "Lyrics Analyzer," and "Emoji Lyrics Converter". The User acknowledges that the Lyrics Retrieval tool searches for song information and lyric sources from external databases. The "Emoji Lyrics Converter" is a creative tool designed to transform text into modern formats with interspersed emojis. The Company claims no ownership over the User's original lyrical content but reserves the right to utilize anonymized lyrical data to train its NLP models under the "AI Learns From My Data" mandate.
The "Market Research" feature provides Users with access to industry insights, including Global Music Streaming Market data, Billboard Chart Analytics, and Music Industry Demographics. The User understands that this data is aggregated for educational purposes. While the Company utilizes secure AI learning to track research interests, it does not warrant the real-time accuracy of third-party data sources. Decisions made by the User regarding marketing budgets or release strategies based on these insights are the sole responsibility of the User.
The App employs advanced "Time Series Analysis" to generate a 52-week streaming forecast, estimating metrics such as "Peak Week," "Total Streams," and "Viral Probability". These predictions are calculated using audio features like Energy, Danceability, and Tempo. The User expressly acknowledges that these forecasts are probabilistic models based on historical trends and do not constitute a guarantee of future performance.
The "Studio Corrector" suite features proprietary "Zero-Iteration Mastering" and "Advanced Mixing" technologies. Unlike traditional limiters that may introduce buffering artifacts, the Company’s Zero-Iteration engine calculates gain reduction instantly upon file load using a 32-bit float architecture to ensure "Pristine Processing". The User acknowledges that the "Static Addition Prevention Active" protocol blocks code attempting to add noise, but the Company cannot remove static that is inherent to the User's original source recording.
The "Video Studio" and "Spectro Lyric Studio" features may integrate with or recommend third-party AI generation tools such as Google Veo 2.0 or Google Flow. The User acknowledges that use of these third-party tools may require separate billing or cloud connections. SpectroModel is not liable for the content generated by third-party AI engines.
The "Collaboration Projects" feature facilitates real-time co-editing, chat, and task management. By initiating a project, the User accepts that all project data is automatically saved to their connected cloud account via the "Cloud Connection" protocol. The Company monitors collaboration patterns to improve workflow efficiency under the "AI Learns From Your Data" mandate. The Creator(s)/Owner(s) of the project retains administrative control and liability for the content shared within the collaboration workspace.
The "Artist Vault" is a secure storage environment for unreleased masterpieces, video, and lyrics. The User acknowledges that while the Vault employs end-to-end encryption, the contents stored therein are subject to the "AI Learns From Your Data" protocol to train the User’s personal creative AI model. Files are synced across authenticated devices. The Company guarantees that files exceeding the 2000MB limit or unsupported file types will be rejected.
The App includes a "Copyright Protection & Registration" tool that generates a SHA-256 timestamped certificate proving the creation time of a work. IMPORTANT NOTICE: This digital timestamp serves as proof of creation but does NOT constitute a formal federal copyright registration. For full legal protection, the User MUST register their work with the U.S. Copyright Office. The Company does NOT permanently store the User's raw audio files associated with this registration.
The "Music Education Hub" provides interactive lessons, quizzes, and progress tracking (e.g., "Beginner" to "Apprentice"). Users agree to utilize these resources for personal growth. The "AI tracks your learning" feature monitors performance to personalize the curriculum. Any attempt to manipulate leaderboard scores or engage in academic dishonesty will result in a reset of "Streak" metrics and potential suspension of the education profile.
The "Audio to MP3 Converter" feature allows Users to convert various formats (WAV, FLAC, etc.) to high-quality MP3s. The Company employs a "Browser-Based" processing engine for this specific tool, ensuring that files never leave the User's device during conversion, thereby guaranteeing 100% privacy for this specific operation.
SpectroModel acknowledges peer-reviewed research regarding cultural bias in traditional music analysis algorithms. The Company incorporates "African-centered methodologies" and diverse training datasets into its Genre Classification and Market Fit models to mitigate these biases and correct the Western world's understanding of global music traditions. All algorithmic implementations are proprietary and developed independently by SpectroModel ENT.
The App features an "AI Music Assistant" capable of answering queries regarding music production tips and hit prediction methodology. The User acknowledges that this Assistant "learns from every query" and is trained on the User's specific dataset. The Company does not guarantee the infallibility of its advice. The User consents to the recording of text-based interactions to improve conversational accuracy.
The "Agent Deployment" feature enables Users to deploy autonomous AI agents capable of performing tasks such as data analysis, workflow automation, and intelligent recommendations. This feature is available to Pro and Premium subscription holders with limited functionality available to Free tier users. The User acknowledges that deployed agents operate under the "AI Learns From My Data" mandate and utilize proprietary machine learning models developed exclusively by SpectroModel ENT. The User agrees that: (a) agents are deployed at the User's own risk; (b) the Company is not liable for decisions made by autonomous agents; (c) agent behavior is subject to continuous improvement and may change without notice; (d) deployed agents may access User data to perform their designated functions. The User warrants that they will not deploy agents for malicious purposes, spam generation, or any activity that violates this Agreement or applicable law.
The "Advanced Analytics" suite provides insights including "Cognitive Impact" and "Emotional Response" analysis. The User understands that the "Cognitive Impact" tool is a computational simulation based on psychoacoustic models and does not constitute a medical neurological scan. These tools are strictly for enhancing the User's understanding of potential audience reactions.
The "Distribution & Promotion" module acts as a central command center for "One-Click Promotion Launch" to external platforms like Spotify for Artists and TikTok. The User acknowledges that SpectroModel is a management interface and not a distributor. The Company is not responsible for the terms of service or account bans that may occur on third-party platforms.
The App offers "Color Theme" customization based on color psychology research (e.g., "Trust Blue" to reduce anxiety). The User acknowledges that these effects are statistical averages derived from research and do not constitute a medical treatment. The Company tracks theme preferences to personalize the dashboard experience.
SpectroModel employs a "Military-Grade Security v8.0.0" infrastructure utilizing AES-256-GCM encryption, SHA-512 hashing, RSA-4096 key exchange, Multi-Factor Authentication (MFA), and Zero-Trust Architecture. The App features an active "Anti-Spyware" module, "Real-Time Threat Detection," "Device Fingerprinting," and a "Code Integrity" lock that prevents unauthorized modifications. All security protocols are continuously updated and AI-enhanced to adapt to emerging threats across all device types (Desktop, Mobile, Tablet), all operating systems (Windows 10/11, macOS 12+, Linux, iOS 15+, Android 11+), and all major browsers (Chrome 100+, Firefox 100+, Safari 15+, Edge 100+, Opera 90+, Brave, Vivaldi). The User agrees not to attempt to bypass, disable, or circumvent these security features. The User accepts that while the Company exerts maximum effort to neutralize threats through automated defense systems, no digital system is entirely impenetrable, and the User bears responsibility for maintaining secure passwords, enabling MFA, and ensuring device security.
The Company reserves the right to suspend or terminate a User's account for violations of this Agreement. Upon termination, access to the App and stored data will be revoked. Anonymized data points used to train algorithmic models may be retained indefinitely as part of the App's intellectual property.
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, United States, and all applicable federal, state, and local laws, without regard to conflict of law provisions. Any legal action, suit, or proceeding arising out of or relating to this Agreement shall be brought exclusively in the federal or state courts located in Maricopa County, Arizona. The parties hereby irrevocably consent to the personal jurisdiction of such courts. This provision applies to all Users regardless of geographic location, subject to applicable mandatory consumer protection laws in the User's jurisdiction.
The "Studio Corrector" includes an "Advanced Mixing" module with DSP parameters like "Advanced Compression" and "Audio Delay". The User acknowledges that these tools modify the frequency spectrum. The Company is not responsible for degradation of audio quality or artifacts resulting from the User's manipulation of these parameters.
The "AI Director" feature in SpectroVerse allows Users to select behavioral goals like "Increase Energy". The "Real-Time ML Adaptation Engine" interprets these goals to adjust lighting and crowd behavior. The Company does not guarantee that the AI Director’s interpretation will always align with the User's artistic vision.
The "Digital Collectibles" section enables Users to mint NFTs. The User acknowledges that SpectroModel provides the interface but does not act as a financial custodian or wallet provider. The User is solely responsible for gas fees and legal compliance regarding digital asset sales.
The Music Education Hub utilizes a gamification system with badges and points. The User agrees that these rewards have NO MONETARY VALUE and serve solely as motivational tools. The Company reserves the right to adjust point values at any time.
The "Automation" feature allows Users to create rules like "When task is completed → Send notification". The User agrees not to create infinite loops or rules designed to overload the system. The Company reserves the right to disable abusive automation rules.
The "Spectro Lyric Studio" generates 3D lyric videos using AI prompts. The User acknowledges that this may utilize "Google Cloud Connected" services and that Google Cloud billing may be required for high-definition generation. The Company is not liable for costs incurred on external platforms.
The User has the right to "Download All Data from Cloud" in JSON format. This export serves as a backup. The Company does not guarantee compatibility with third-party applications and is not responsible for the security of data once downloaded.
The "Sibilance Corrector" and "Consonant Corrector" tools are based on peer-reviewed research. They are created with the Company's/Owner's proprietary, original code after learning from the academic articles. The User accepts that parameters like "Missing Phoneme Threshold" are preset values derived from these studies. The Company does not guarantee perfect reconstruction of missing audio information.
SpectroModel supports "High Contrast Mode" and "Large Touch Targets" to accommodate users with disabilities. The App is compatible with major screen readers like JAWS and NVDA. However, the Company does not guarantee perfect compatibility with every third-party plugin or update.
The App is optimized for Desktop, Tablet, and Mobile. The "Universal File Upload" feature bypasses iPad file restrictions to accept all file types. The User agrees that the Company is not responsible for OS-level restrictions or file corruption on the User's device.

The User agrees not to disparage these trademarks or use them in a manner that suggests endorsement or affiliation where none exists. The User agrees that the "unauthorized reproduction... or distribution of Company assets" via third-party file-sharing sites or unauthorized repositories is a violation of international copyright law. The User accepts full liability for any "statutory damages" assessed against the Company due to the User's facilitation of piracy on external platforms.
Consistent with Section 3.3.3, the Company reserves the right to seek "injunctive relief" against any User or third-party entity hosting stolen Company assets. The User agrees that SpectroModel may petition courts to compel Internet Service Providers (ISPs) or cloud hosts to terminate services for sites distributing the App's proprietary algorithms without authorization.
The User acknowledges that the distribution of the "Zero-Iteration" engine on third-party platforms causes irreparable harm to the Company's business model. The User waives the requirement for the Company to prove actual monetary loss before seeking "all available legal remedies" to halt third-party infringement.
Consistent with Section 3.3.4, the User acknowledges that using third-party tools to exfiltrate "proprietary algorithms" or "trade secrets" from the App is a criminal act. The User agrees that the "Criminal prosecution" clause applies to the theft of API keys or the automated scraping of the "Market Fit" database for use in competing third-party products.
The User accepts that "This provision applies globally". In the event of IP theft involving international third parties, the User agrees that the Company may coordinate with Interpol or local authorities to enforce the "laws governing SpectroModel's incorporation".
Consistent with Section 3.3.5, the User agrees that any IP dispute arising from their use of third-party platforms to interact with the App is "enforceable under the laws governing SpectroModel's incorporation". The User waives the right to claim that the jurisdiction of the third-party platform (e.g., a server in a different country) overrides the jurisdiction of SpectroModel ENT.
The User acknowledges that "The Creator(s)'s authority in defining and enforcing these rights is absolute and non-negotiable". This includes the right to define what constitutes an "unauthorized third-party integration" or "wrapper" application.
Consistent with Section 4.3.1, the User acknowledges that their license to use the Company's "proprietary algorithms" is contingent upon adherence to the "Conduct & Ethics" policy. The User agrees that engaging in "unauthorized reproduction" for the purpose of harassment or hate speech constitutes a material breach. The Company reserves the right to revoke all IP licenses and terminate access immediately upon detection of such conduct.
The User accepts that utilizing the App to create defamatory content or "XXX adult videos" is a "material breach of this Agreement". The User agrees that in such cases, the Company retains "absolute, perpetual... ownership" of the underlying technology used to create the offending content and may utilize technical measures to disable it.
Consistent with Section 4.3.2, the User is prohibited from "reverse engineering" the App to discover vulnerabilities for malicious exploitation. The User agrees that attempting to analyze the "source code" to bypass the "Anti-Harassment" filters or "No-Interference" protocol will be met with "criminal prosecution".
The User acknowledges that the code governing User safety (e.g., the "Block" function) is a "trade secret". The User agrees not to distribute tools or scripts designed to circumvent these safety features. The Company’s "Automated enforcement active" system specifically scans for patterns indicative of "safety bypass" attempts.
Consistent with Section 4.3.3, the Company reserves the right to seek "injunctive relief" to prevent the User from publishing content created with the App that violates the "Conduct & Ethics" standards. The User agrees that the Company may petition platforms to remove such content based on the User's breach of the IP license.
The User acknowledges that using the Company's IP to generate unethical content damages the "SpectroModel" brand. The User agrees to be liable for "statutory damages" resulting from this reputational harm.
Consistent with Section 4.3.4, the User agrees that using the App's "design elements" or code to commit cybercrimes (e.g., phishing, identity theft) will result in "criminal prosecution". The User acknowledges that the Company will cooperate with law enforcement to provide evidence of such misuse.
The User accepts that "This provision applies globally". Whether the User is in a jurisdiction with lax cybercrime laws or not, the User agrees that the "laws governing SpectroModel's incorporation" apply to their theft or misuse of the App's code for criminal purposes.
Consistent with Section 4.3.5, the User accepts that "The Creator(s)'s authority in defining and enforcing these rights is absolute and non-negotiable". The User agrees that the Creator(s) has the sole discretion to determine if a specific use of the "proprietary algorithms" violates the ethical standards of the community.
Consistent with Section 5.3.1, the User acknowledges that paying for a subscription or "Premium" tier does not convey ownership of the "proprietary algorithms" or "source code". The User agrees that payment grants a limited license, not a transfer of copyright. The Company retains "absolute, perpetual... ownership" regardless of the amount paid by the User.
The User agrees that requesting a refund or initiating a chargeback constitutes a retroactive revocation of the license to use the Company's IP. The Company reserves the right to pursue "legal remedies" to recover value if the User continues to utilize the App after a payment dispute.
Consistent with Section 5.3.2, the User acknowledges that purchasing access to "Premium" tools like the "AI Vocal Isolation" engine does not grant the right to "reverse engineering" or inspect the underlying code. The User agrees that the "Company... retains absolute... ownership" of the premium algorithms. The User is prohibited from using their paid access to capture, analyze, or decompile the binary stream of the "Zero-Iteration" processor.
The User accepts that "This provision applies globally". Regardless of local laws that might allow reverse engineering for interoperability, the User waives these rights as a condition of the subscription contract. The User agrees that the "laws governing SpectroModel's incorporation" control the interpretation of this restriction.
Consistent with Section 5.3.3, the Company reserves the right to seek "injunctive relief" if the User exploits payment gateways or subscription tokens to distribute the App's assets illegally. The User agrees that SpectroModel may block the User's financial accounts and freeze assets to prevent further damage to the Company's revenue stream.
The User acknowledges that bypassing the payment wall to access "proprietary algorithms" causes significant financial harm. The User agrees to be liable for "statutory damages" calculated based on the lifetime value of the stolen services. The "Creator(s)'s authority in defining... these rights is absolute".
Consistent with Section 5.3.4, the User acknowledges that obtaining paid features through fraud, hacking, or the use of stolen credit cards constitutes "criminal prosecution". The User agrees that the theft of the "design elements" or "trade secrets" behind the "Monetization Hub" will be reported to federal authorities.
The User accepts that "This provision applies globally". The User acknowledges that the Company will utilize international legal frameworks to prosecute the theft of its services, regardless of the User's location. The "laws governing SpectroModel's incorporation" serve as the basis for defining the criminal act.
Consistent with Section 5.3.5, the User agrees that any dispute regarding payments, refunds, or the ownership of paid features is "enforceable under the laws governing SpectroModel's incorporation". The User waives the right to litigate billing disputes in their local small claims court.
The User accepts that "The Creator(s)'s authority in defining and enforcing these rights is absolute and non-negotiable". This includes the determination of whether a refund is warranted or if a chargeback constitutes a breach of contract.
The User acknowledges that the Company utilizes Google Ads (formerly Google AdWords) and related Google advertising services to promote the SpectroModel platform. By accessing or using the Service, the User consents to the data collection practices described herein, which are conducted in full compliance with the Google Ads Terms of Service, the Google Ads Data Processing Terms, the Google Privacy Policy, and all applicable Google advertising policies. The Company incorporates by reference the following Google policies: (a) Google Ads Personalized Advertising Policy; (b) Google EU User Consent Policy; (c) Google Ads Misrepresentation Policy; (d) Google Ads Data Collection and Use Policy; (e) Google Ads Remarketing Policy; and (f) Google Analytics Terms of Service. The User agrees that these policies, as amended by Google from time to time, apply to the advertising-related data collection practices of the Service.
When the Company runs advertising campaigns through Google Ads or similar platforms, the following categories of User data may be collected, processed, and utilized: (a) Device and Browser Information: device type, operating system, browser type and version, screen resolution, and hardware identifiers; (b) Network Information: IP address, internet service provider, and approximate geographic location (city, region, country); (c) Behavioral Data: pages visited, features accessed, session duration, click patterns, scroll depth, and interaction events; (d) Conversion Data: sign-up completions, subscription purchases, feature activations, and other goal completions; (e) Advertising Identifiers: Google Advertising ID (GAID), Identifier for Advertisers (IDFA), cookie identifiers, and pixel-based tracking data. This data is collected for the following legitimate purposes: advertising campaign delivery and optimization, performance measurement and attribution, audience segmentation and market research, remarketing and retargeting to Users who have previously visited the Service, lookalike audience creation for prospecting campaigns, and A/B testing of advertising creative and landing pages.
The Company conducts market segmentation and audience research using data collected through advertising platforms and analytics tools. This research enables the Company to: (a) identify and target potential Users based on demographic, geographic, psychographic, and behavioral characteristics; (b) analyze the effectiveness of marketing messages across different audience segments; (c) optimize advertising spend by allocating budget to the highest-performing channels and audiences; (d) develop User personas to inform product development and feature prioritization; (e) measure brand awareness, consideration, and preference across target markets. The User acknowledges that market segmentation data is processed in aggregate form and is not used to make individual decisions about Users. The Company may share anonymized, aggregated audience insights with advertising partners solely for campaign optimization purposes, in compliance with GDPR Article 6(1)(f) (legitimate interests) and CCPA requirements.
The Service and its advertising partners use cookies, web beacons, pixels, local storage, and similar tracking technologies to facilitate advertising delivery and measurement. The User acknowledges the following categories of advertising-related cookies: (a) Essential Advertising Cookies: required for basic ad serving and fraud prevention; (b) Performance Cookies: used to measure advertising campaign performance, including Google Analytics cookies (_ga, _gid, _gat); (c) Targeting Cookies: used for remarketing and interest-based advertising, including Google Ads cookies (IDE, ANID, NID); (d) Social Media Cookies: used when Users interact with social sharing features. For Users in the European Economic Area (EEA), the United Kingdom, and other jurisdictions requiring affirmative consent, the Company implements a consent management platform in compliance with the Google EU User Consent Policy, the ePrivacy Directive (Directive 2002/58/EC), and GDPR Article 7. Users may manage their cookie preferences at any time through the Service's cookie settings, their browser settings, or the following opt-out mechanisms: Google Ads Settings (adssettings.google.com), Digital Advertising Alliance (optout.aboutads.info), Network Advertising Initiative (optout.networkadvertising.org), and European Interactive Digital Advertising Alliance (youronlinechoices.eu).
The Company may use Google Ads Remarketing and Similar Audiences features to display targeted advertisements to Users who have previously visited or interacted with the Service. The User acknowledges that: (a) remarketing lists are created based on User interactions with the Service, such as pages visited, features used, and subscription status; (b) the Company does not include Users in remarketing lists based on sensitive categories as defined by Google Ads policies; (c) remarketing advertisements may appear across the Google Display Network, Google Search Network, YouTube, and partner websites; (d) the User may opt out of remarketing at any time through their Google Ads Settings or by clearing their browser cookies; (e) the Company adheres to minimum list sizes and frequency caps as required by Google Ads policies to protect User privacy.
All advertising technologies and data collection practices implemented by the Company are optimized for full compatibility across the following environments: Desktop Operating Systems (Windows 10/11, macOS 12+, Linux distributions including Ubuntu 20.04+ and Fedora 35+); Mobile Operating Systems (iOS 15+ on iPhone and iPad, Android 11+ on all devices); Tablet Devices (iPad with iPadOS 15+, Android tablets, Microsoft Surface); Web Browsers (Google Chrome 100+, Mozilla Firefox 100+, Apple Safari 15+, Microsoft Edge 100+, Opera 90+, Brave, Vivaldi, Samsung Internet, and all Chromium-based browsers); and Web Views (in-app browsers on iOS and Android). The Company ensures that advertising consent mechanisms, opt-out controls, and privacy settings function correctly across all supported platforms, browsers, and device types. Screen sizes from 320px (small mobile) to 8K displays are supported with no horizontal overflow or layout issues in advertising consent interfaces.
Advertising-related data is retained for the following periods: (a) Campaign Performance Data: retained for up to thirty-six (36) months for longitudinal performance analysis; (b) Conversion Data: retained for up to twenty-four (24) months for attribution modeling; (c) Remarketing Lists: retained for up to five hundred forty (540) days as permitted by Google Ads policies; (d) Aggregated Analytics Data: retained indefinitely in anonymized form for market research purposes. The User has the right to request the deletion of their advertising-related personal data at any time, subject to the Company's legitimate retention needs and legal obligations. Deletion requests are processed within thirty (30) days in accordance with GDPR Article 17 (Right to Erasure) and CCPA Section 1798.105.
The Company commits to the following advertising standards: (a) the Company shall not engage in misleading or deceptive advertising practices; (b) the Company shall not use sensitive personal data categories for advertising targeting; (c) the Company shall not collect data from Users under the age of thirteen (13) for advertising purposes, in compliance with COPPA; (d) the Company shall not serve personalized advertisements to Users who have opted out of personalized advertising; (e) the Company shall prominently disclose all material connections and sponsorships in advertising content; (f) the Company shall ensure all landing pages accurately represent the Service and do not redirect Users to unexpected destinations, in compliance with the Google Ads Destination Requirements Policy and the Google Ads Misrepresentation Policy; (g) the Company shall maintain transparent pricing and shall not employ bait-and-switch tactics in advertising creative.
By clicking "I Agree," accessing the Dashboard, or uploading any file to SpectroModel, the User acknowledges that they have read, understood, and agree to be bound by this Master Service Agreement, the Privacy Policy, and all associated intellectual property declarations.

"AI Learns From My Data." The Company may retain User data to train and improve the App. This data is used to refine algorithms (e.g., genre detection, hit prediction) and improve accuracy without prejudice or discrimination. User expressly consents to this usage by accessing the platform, in accordance with GDPR Article 6(1)(a) and FTC guidelines on data transparency.
User information will NOT BE WILLINGLY SHARED with third parties. The Company protects User secrets, codes, and proprietary algorithms. User data is protected from unauthorized access using industry-standard AES-256 encryption and secure transmission protocols.
All payment transactions are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. Accepted payment methods: Credit Cards (Visa, MasterCard, Amex), Debit Cards (all banks), and Cryptocurrency (BTC, ETH, USDT, USDC). Credit card data is encrypted in transit and at rest using AES-256 encryption. The Company does not store complete card numbers on its servers. Payment verification occurs in real-time before any charges are processed. Failed transactions due to declined cards or insufficient funds will not process. All successful payments generate authentic transaction IDs. Compatible with all platforms: Desktop (Windows, macOS, Linux), Mobile (iOS 15+, Android 11+), Tablet, and all major browsers (Chrome, Firefox, Safari, Edge, Opera, Brave).
The Company may utilize Google Ads and other third-party advertising platforms to promote the Service. By using the App, the User acknowledges and consents to the following: (a) Google Ads and associated services (including Google Analytics, Google Tag Manager, and Google Remarketing) may collect User data such as IP addresses, device identifiers, browser type, operating system, geographic location, pages visited, session duration, and interaction events for the purposes of advertising delivery, performance measurement, market segmentation, and audience research; (b) such data collection is governed by the Google Ads Terms of Service, the Google Privacy Policy, and the Google Ads Data Processing Terms, all of which are incorporated herein by reference; (c) the Company adheres to all applicable Google Ads policies, including but not limited to the Google Ads Personalized Advertising Policy, the Google EU User Consent Policy, and the Google Ads Misrepresentation Policy; (d) Users in the European Economic Area (EEA) and United Kingdom are subject to additional consent requirements under the EU ePrivacy Directive and GDPR, which the Company implements through compliant consent mechanisms.
The Company may use data collected through advertising platforms for market segmentation, audience research, behavioral analytics, conversion tracking, and remarketing campaigns. This data enables the Company to deliver relevant advertisements, measure campaign effectiveness, and improve the overall User experience. The User acknowledges that: (a) advertising cookies and tracking pixels may be placed on the User's device when interacting with the Service or Company advertisements; (b) the User may opt out of personalized advertising through their Google Ads Settings (adssettings.google.com), the Digital Advertising Alliance (optout.aboutads.info), or the Network Advertising Initiative (optout.networkadvertising.org); (c) opting out of personalized advertising does not prevent the display of non-personalized advertisements; (d) the Company does not sell User personal data to advertisers but may share anonymized, aggregated analytics data with advertising partners for campaign optimization purposes.
The Service may incorporate third-party advertising technologies including but not limited to Google Ads, Google Analytics 4, Google Tag Manager, Facebook Pixel, and similar advertising measurement tools. These technologies may collect data automatically through cookies, web beacons, pixels, and similar tracking technologies. The Company ensures that all third-party advertising integrations comply with applicable data protection regulations including GDPR Article 6(1)(a) (consent-based processing), CCPA Section 1798.120 (right to opt out of sale of personal information), and FTC guidelines on online behavioral advertising. The User's continued use of the Service after being notified of these advertising practices constitutes consent to such data collection, subject to the User's right to withdraw consent at any time through the methods specified in this Agreement.
The Company may engage in cross-device and cross-platform advertising campaigns. The User acknowledges that advertising identifiers from multiple devices and browsers may be linked to provide a unified advertising experience. This practice complies with the Google Ads Cross-Device Measurement policies and applicable privacy regulations. The Company does not use sensitive personal data categories (as defined by Google Ads policies) for advertising targeting, including but not limited to health information, financial status, racial or ethnic origin, religious beliefs, sexual orientation, or political affiliation. All advertising practices are optimized for compatibility across all browsers (Chrome, Safari, Firefox, Edge, Opera, Brave, Vivaldi), all device types (desktop, tablet, mobile), and all operating systems (Windows, macOS, Linux, iOS, Android).
Users can download their data from the App. Users can add/remove privacies in settings. Users have the right to request deletion of their account and associated personal data, subject to retention required for legal compliance or platform security.
Any invasion of privacy targeting the User or especially the Creator(s)/Owner(s)/Company (SpectroModel) is punishable by a warning, a permanent or indefinite ban, a lawsuit, a civil suit, a fine, and in instances of breaking the law, jail time as determined by governmental, federal, state, local, or proximity laws.
The Creator(s) will monitor security and may remotely access User accounts with User permission, unless the User violates Company policy. Users may be banned for misuse of the Creator(s)'s App. Accounts are secured with military-grade encryption (AES-256-GCM), SHA-512 hashing, RSA-4096 key exchange, Multi-Factor Authentication (MFA), and Zero-Trust Architecture. Payment methods are protected via PCI-DSS Level 1 compliant infrastructure. All security protocols are optimized for all devices (Desktop, Mobile, Tablet), all operating systems (Windows, macOS, Linux, iOS, Android), and all major browsers (Chrome, Firefox, Safari, Edge, Opera, Brave, Vivaldi).

The Company employs machine learning models for threat detection, anomaly identification, and security enhancement. All AI learning is conducted in compliance with GDPR, FTC, and applicable data protection regulations. Security protocols are continuously updated to protect against emerging threats. The AI security engine learns from every interaction across all features of the platform to strengthen defenses in real time.
The Customize button, New Analysis button, Quick Actions buttons, and Filter Bar are displayed as locked prior to User interaction upon navigating from the Landing Page to the Dashboard. The App is designed to function correctly upon first use. No feature, clause, or agreement unlocks based on a failure to initialize. This is a premier application; the App performs all stated functions.
The App functions regardless of the User's belief or disbelief in its operation. The App uses no ultrasound, silent sound, ultralight, ultra-frequencies, or any normal or regular frequency to unlock features. The code will not change based on any undetected sound or light that humans do not perceive, nor based on any frequency that humans do or do not perceive. The App does not unlock via echo, sonar, triangulation, or similar methods.
The App strictly enforces a "No Triangulation" policy regarding User location. Security protocols are updated and optimized to ensure the highest level of protection.
The App is optimized for all device types and platforms: Desktop (Windows 10/11, macOS 12+, Linux including Ubuntu 20.04+ and Fedora 35+), Mobile (iOS 15+ on iPhone/iPad, Android 11+ on all devices), Tablet (iPad with iPadOS 15+, Android tablets 10"+), and all major Browser Types (Chrome 100+, Firefox 100+, Safari 15+, Edge 100+, Opera 90+, Brave, Vivaldi). Features include responsive design, touch optimization, screen rotation support (landscape/portrait), hardware acceleration, PWA installation capability, and full accessibility compliance (WCAG 2.1 AA). The app supports screen sizes from 320px (small mobile) to 8K displays with no horizontal overflow.
No entity possesses power over, in, above, under, parallel to, perpendicular to, adjacent to, or around the App in any combination. No mathematical formula, algorithm, or science, known or unknown, overrides this sovereignty. User accounts are protected to the highest standard. The App is not, was not, and shall not be used for political endorsements. It is intended to be informative, educational, entertaining, and economical for all Users. The App does not discriminate based on race, color, complexion, sexual orientation, preference, religion, religious beliefs, demographics, or socioeconomic status. Any interpretation of algorithmic bias is unintentional; no analysis is designed to discriminate or exhibit prejudice against anyone. The App is not intended to segregate. Everyone is welcome, provided they adhere to the agreements and terms and do not exploit, negate, or devolve the App. Exploitation, negation, or devolution of the App in any form—whether parallel, adjacent, perpendicular, underneath, or above—is strictly prohibited.
The App utilizes no ultrasound, silent sound, ultralight, ultra-frequencies, or any normal or regular frequency to unlock capabilities. The code remains immutable regarding undetected sounds or lights that humans do not perceive, as well as frequencies that humans do or do not perceive. The App does not unlock via echo, sonar, triangulation, or other covert methods.
We enforce a strict NO TRIANGULATE USER LOCATION policy. User location is used solely for legitimate app functionality (e.g. timezones) and is never used for triangulation or unauthorized tracking. Security is updated and optimal.
All content, code, algorithms, designs, interfaces, and intellectual property contained within this App are the exclusive property of SpectroModel ENT. ("Company") and its Creator(s). No part of this App may be reproduced, reverse-engineered, or exploited without express written permission.
The names "SpectroModel", "SpectroVerse", "Spectro Lyric Studio", and all associated logos and designs are trademarks of the Company. Unauthorized use is strictly prohibited and will be prosecuted to the fullest extent of the law.
Users agree not to create derivative works, copies, or competitive products based on the Company's intellectual property. Any such attempts will be met with immediate legal action.
