The "Live Video Stream" utilizes "AI Learning" to optimize bitrate and latency based on connection quality. The User acknowledges that stream metadata (not content) is analyzed to train the "Auto-Healing" network protocols. The User agrees that the Company does not record the video content of these streams unless a specific recording feature is activated, and even then, storage is subject to the User's cloud quota.

SECTION CLXXXVII: SOCIAL HUB & SYSTEM MESSAGING

187.1 SYSTEM WELCOME PROTOCOLS

The "Social Hub" within the SpectroVerse generates automated "System" messages, such as "Welcome to SpectroVerse!". The User acknowledges that these messages are programmatic and do not represent a human moderator's presence. The User agrees that the "Type a message..." input field is subject to the "AI chatbots block harassment" filters. The Company reserves the right to mute or ban Users who attempt to bypass these filters using "leet speak" or obfuscated text.

187.2 TALENT ROSTER ASSET USAGE

The User acknowledges the "Talent Roster" listing specific digital assets by ID (e.g., "PIXELYNX_1763198367311"). The User agrees that selecting an asset from this roster grants a limited license to use that avatar within the SpectroVerse scene. It does not convey ownership of the 3D model's source geometry or texture maps. The User is prohibited from ripping or extracting these assets for use in third-party game engines.

SECTION CLXXXVIII: UNIVERSAL FILE SAFETY & MALWARE

188.1 ARCHIVE & CODE UPLOAD RISKS

The "Universal File Upload" feature accepts "Archives" (e.g., .zip, .rar) for storage purposes. The User acknowledges that the Company performs basic virus scanning but cannot guarantee that user-uploaded archives are 100% free of malware. The User agrees that downloading files from a "Collaboration Project" is done at their own risk. The User is responsible for scanning all downloaded "Archives" and "Code" files with local antivirus software before execution.

188.2 SPREADSHEET & DOCUMENT HANDLING

The User acknowledges that uploading "Spreadsheets" and "Documents" allows for team file sharing. The Company asserts that these files are stored in the "User Data Isolated" container. The User agrees not to use this feature to distribute illegal content, hate speech manifestos, or pirated e-books. The Company reserves the right to delete files that violate the "Conduct & Ethics" policy upon detection or report.

SECTION CLXXXIX: GLOBAL LANGUAGE & AMBIGUITY

189.1 TRANSLATION AMBIGUITY CLAUSE

The User explicitly agrees that "Ambiguity in translation shall not be used to void these terms". While the App supports multiple languages, the English version of the Master Service Agreement is the controlling document. The User acknowledges that automated translations provided by the App or browser extensions may lack legal precision. In any dispute regarding the definition of terms like "Intellectual Property" or "Liability," the English definition provided by the Creator(s) shall prevail.

189.2 EQUITABLE REQUEST PROCESSING

The Company states that "Requests in different languages are treated the same". The User acknowledges that support tickets or data deletion requests submitted in non-English languages may require additional processing time for translation. The User agrees that the Company is not liable for delays caused by the translation process.

SECTION CXC: AI ISSUE RESOLVER BETA STATUS

190.1 BETA FEATURE LIMITATIONS

The "AI Issue Resolver" is explicitly labeled as "BETA". The User acknowledges that this tool is experimental. The User agrees that advice given by the AI regarding technical issues (e.g., "My audio file won't upload") is generated based on pattern recognition and may not solve unique hardware conflicts. The Company disclaims liability for any data loss or frustration caused by reliance on this beta feature.

190.2 RESOLUTION LEARNING MANDATE

The User consents to the mandate that "AI learns from every resolution to improve support". The User acknowledges that the details of their technical issue and the effectiveness of the provided solution are recorded to refine the support model. The User agrees not to submit sensitive personal information (e.g., passwords) into the Issue Resolver text field.

SECTION CXCI: DISTRIBUTED TEAM BANDWIDTH & STREAMING

191.1 LIVE STREAM BANDWIDTH CONSUMPTION

The User acknowledges that utilizing the "Live Video Stream" feature within a "Collaboration Project" consumes significant upstream bandwidth. The User agrees that the quality of the stream (e.g., resolution, frame rate) is dynamically adjusted by the "AI Learning" protocol to maintain stability. The Company is not liable for connection drops or "lag" experienced by team members if the hosting User's internet upload speed is insufficient to support the encrypted video tunnel. The User accepts that the "0" viewer count is the default state until a handshake is established with another authenticated User.

191.2 SCREEN SHARE SECURITY HYGIENE

When initiating a "Start Screen Share" session, the User expressly agrees to close all non-essential applications to prevent the accidental broadcast of private data. The User acknowledges that the Company’s "E2E Encrypted" pipeline protects the stream from external hackers but cannot redact sensitive information (e.g., personal emails, bank balances) that the User voluntarily displays to their collaborators. The User assumes full liability for any "doxing" or privacy leaks that occur due to their own negligence during a screen share event.

SECTION CXCII: EDUCATIONAL ACCREDITATION & VIRTUAL REWARDS

192.1 NON-ACCREDITED STATUS OF EDUCATION HUB

The "Music Education Hub" provides a structured curriculum with levels such as "Beginner" and "Apprentice". The User explicitly acknowledges that SpectroModel is a software company, not an accredited university or conservatory. Completion of "Lessons" or "Quizzes" does not confer a degree, diploma, or certification recognized by third-party educational institutions or employers. The "Scholar" and "Explorer" badges are virtual tokens of engagement, not academic credentials.

192.2 NO MONETARY VALUE OF BADGES

The User agrees that virtual rewards, including "Hot Streak" counters and "Perfect Score" badges, have no monetary value. They cannot be exchanged for fiat currency, cryptocurrency, or subscription credit. The Company reserves the right to reset "Leaderboard" standings or modify point values at any time to maintain the integrity of the gamified ecosystem.

SECTION CXCIII: MARKETING LAUNCHER & EXTERNAL SESSIONS

193.1 MARKETING COMMAND CENTER SESSION MANAGEMENT

The "Marketing Command Center" features a "LAUNCH ALL PLATFORMS" button designed to open multiple external dashboards simultaneously (e.g., Spotify for Artists, Instagram, TikTok). The User acknowledges that this feature relies on the User having active, logged-in sessions on these third-party websites within their browser. The Company does not manage these external sessions or store the User's passwords for sites like Twitter/X or LinkedIn. The User agrees that SpectroModel is not responsible for login failures or "session timeout" errors on external platforms.

193.2 CAMPAIGN STRATEGY VS. EXECUTION

The App generates "AI Strategy" for campaigns, covering "Playlist Pitching" and "Audience" targeting. The User expressly agrees that these strategies are algorithmic suggestions. The execution of these strategies—specifically the drafting of pitch emails, the creation of ad creative, and the payment of ad spend—is the sole responsibility of the User. The Company is not liable for the failure of a campaign to achieve desired results even if the AI strategy was followed precisely.

SECTION CXCIV: ARCHIVE UPLOADS & SECURITY RISKS

194.1 ARCHIVE FILE DECOMPRESSION

The "Universal File Upload" system accepts "Archives" (e.g., .zip, .rar) for storage purposes. The User acknowledges that the App does not automatically decompress or scan the contents of these archives for malware upon upload. The User agrees that downloading and extracting archive files shared by other team members is done at their own risk. The User is responsible for maintaining active antivirus software on their local device to scan these files before opening.

194.2 CODE FILE EXECUTION

The App allows the upload of "Code" files (e.g., .py, .js, .cpp). The User acknowledges that these files are treated as text documents for storage. The App does not provide a runtime environment to execute uploaded code. The User agrees not to upload malicious scripts intended to exploit vulnerabilities in the browser or the cloud storage provider. Any attempt to use the file storage system for command-and-control operations will result in an immediate account ban.

SECTION CXCV: RENEWAL POLICIES & PRICE FLUCTUATIONS

195.1 MARKET-BASED PRICING ADJUSTMENTS

The User acknowledges the clause "The Market sets the price" regarding subscription fees. The User agrees that renewal rates for "Premium" or "Pro" tiers are subject to change based on economic factors. The Company guarantees "No undisclosed upgrades", meaning any price increase will be communicated prior to the renewal date. Continued use of the service after a price adjustment constitutes acceptance of the new rate.

195.2 CONFIRMATION PROMPTS & REFUND WAIVERS

The User accepts the "Non-Refundable" nature of all payments. To prevent accidental purchases, the App enforces an "are you sure" button prompt before finalizing any transaction. The User agrees that confirming this prompt waives their right to a refund for "buyer's remorse" or accidental clicks.

SECTION CXCVI: LINGUISTIC PRECEDENCE & JURISDICTION

196.1 ENGLISH LANGUAGE AUTHORITY

The User agrees that in all legal interpretations of this Agreement, the English language version serves as the authoritative text. "Ambiguity in translation shall not be used to void these terms". If a translated version of the App implies a different level of liability or ownership, the definitions set forth in the English document (e.g., regarding "Intellectual Property" or "Indemnification") shall prevail.

196.2 ARIZONA JURISDICTION & DISPUTE VENUE

The User agrees that all disputes shall be resolved under the laws of the State of Arizona, United States, and all applicable federal, state, and local laws. The User acknowledges that "Violators... will be exposed, reported, and violated (punished) by law once reported as country, state, local proximity deems necessary". This clause establishes the venue for any legal action initiated by the Company against the User for breach of contract or cybercrimes.

SECTION CXCVII: ARBITRATION AND DISPUTE RESOLUTION

197.1 BINDING ARBITRATION CLAUSE

The User agrees that any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona, in the English language, by a single neutral arbitrator mutually agreed upon by the parties, or absent agreement, selected in accordance with AAA procedures. The arbitrator's decision shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

197.2 CLASS ACTION WAIVER

THE USER AGREES THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. To the fullest extent permitted by applicable law, the User waives any right to participate in a class action lawsuit or class-wide arbitration against the Company. The User acknowledges that this waiver is a material condition of access to the Service. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

SECTION CXCVIII: VOLATILE MEMORY & BUFFER CLEARING

198.1 30-60 SECOND BUFFER CLEARANCE

The User acknowledges the specific technical architecture regarding temporary file storage. The Company warrants that "After processing (30-60 seconds), the audio buffer is cleared from memory". The User agrees that this protocol ensures that raw audio files are "NOT permanently stored ANYWHERE" on the Company's infrastructure. Once the analysis results (JSON) are generated and pushed to the User's cloud account, the source file is irretrievably purged from the server's RAM.

198.2 NO LIABILITY FOR UPLOAD INTERRUPTION

Due to this aggressive buffer clearance policy, the User acknowledges that if a network interruption occurs during the 30-60 second processing window, the analysis will fail, and the file must be re-uploaded. The Company is not liable for bandwidth costs associated with re-uploading large assets (e.g., 2000MB video files) due to connection instability during this critical processing phase.

SECTION CXCIX: REDISTRIBUTION & CONSENT HIERARCHY

199.1 PROHIBITION ON UNAUTHORIZED REDISTRIBUTION

The User agrees to a strict prohibition on the duplication or redistribution of the App's services. The User acknowledges that redistribution is only permitted with the "consent and expressed permission of the Founder, Owner(s), Company, or from the Head of Leadership, etc.". This clause establishes a specific hierarchy of consent; permission from a lower-level employee or support agent is insufficient to override this restriction. The User agrees that "theft of app services" includes sharing account credentials or API tokens with unauthorized third parties.

199.2 AMBIGUITY & MULTIVALENCY DEFENSE

The User acknowledges that legal "definitions are subject to ambiguity, multivalency, etc.". The User agrees that in any instance where a term within this Agreement could be interpreted in multiple ways (multivalency), the interpretation that most effectively protects the Company's Intellectual Property and "No Cooperation" stance shall be the binding definition. The User waives the right to exploit semantic ambiguity to justify a breach of contract.

SECTION CC: LIBEL DEFENSE & ALGORITHMIC INTERPRETATION

200.1 ANALYSES ARE NOT DEFAMATION

The User explicitly agrees that "Analyses are not for defamation, libel, etc.". The User acknowledges that a low score on a track, or a "Market Fit" result that deems a song "Weak," is a data point, not a reputational attack. The User agrees not to file civil suits for libel based on the output of the Company’s algorithms. The Company asserts that these outputs "mean nothing beyond what the results display, with no prejudice".

200.2 HIP HOP SCORING CONTEXT

The Company reiterates that "Hip Hop music (80's, 90s, 2000s etc.) is sometimes not considered pop" by current algorithmic standards. The User agrees that a low "Hit Prediction" score for a track in this genre "can mean a great song to urban communities" and does not reflect objective artistic failure. The User indemnifies the Company against claims that the algorithm is biased against specific musical cultures, as the scoring logic is based on specific chart data (Billboard Hot 100), not cultural value.

SECTION CCI: AI MODERATION & BEST EFFORTS

201.1 BEST EFFORT MODERATION

The User acknowledges that "AI chatbots block harassment, racist, and prejudiced statements to the best of the creator(s)'s ability". The User agrees that "best ability" implies that the system is not infallible. The User accepts that the AI may occasionally miss nuanced harassment or trigger false positives. The Company is not liable for emotional distress caused by a failure of the AI moderation filter, provided the Company has made a good-faith effort to implement safety protocols.

201.2 EVOLVING SAFETY STANDARDS

The User accepts that the moderation algorithms "can and may be improved and changed". The Company reserves the right to update its definition of "harassment" or "prejudice" as societal standards evolve. The User agrees to abide by the most current moderation guidelines enforced by the "AI Learning" system.

SECTION CCII: COMPANY DISCRETION & FEATURE EVOLUTION

202.1 FUTURE UPDATES & REMOVAL RIGHTS

The User acknowledges that the SpectroModel platform is not static. The Company expressly reserves the right regarding "Future updates and features are subject to be added". Furthermore, the User agrees that existing "features can and may be removed at the Owner(s)'s or Creator(s)'s discretion". This clause ensures that the Company can deprecate outdated tools (e.g., legacy "Rhythm Analysis" algorithms) to maintain system security and efficiency without being liable for breach of contract regarding the User's preferred workflow.

202.2 UNINTENTIONAL BIAS & ALGORITHMIC IMPROVEMENT

The Company addresses the potential for perceived bias within the "AI chatbots" or analysis coding. The User acknowledges the Company's statement: "If bias may seem to be in the coding, it is not intentional". The User agrees that "The Company can only do so much, and will improve" its models over time. The User accepts that algorithmic bias is a known industry-wide challenge and agrees to support the Company's efforts to rectify these issues through the "AI Learns From My Data" feedback loop rather than through litigation.

SECTION CCIII: CONTENT NEUTRALITY & LEGAL COMPLIANCE

203.1 RELIGIOUS & POLITICAL REFERENCES

The User agrees to the guideline that "Religious and political references and allusions are best kept out of the App". While the App supports genres like "Gospel" and "Christian" music, the User acknowledges that the platform's tools are designed for musical analysis, not political discourse or theological debate. The Creator(s) asserts that they "will try their best" to maintain a neutral environment. The User agrees not to use the "Team Chat" or "Social Hub" to proselytize or campaign, ensuring the workspace remains focused on creative production.

203.2 ADHERENCE TO REGULATORY LAWS

The Company warrants that "the App follows all known state, federal, local, and regulatory laws, mandates, etc.". The User agrees that their use of the App must also comply with these laws. This includes compliance with digital copyright laws (DMCA), data privacy regulations (GDPR/CCPA), and telecommunications laws regarding "Live Video Stream" broadcasting. The User acknowledges that the Company's "No Cooperation" policy does not grant the User immunity from federal or state prosecution if they utilize the App to commit crimes.

SECTION CCIV: ADVANCED CYBER LAW & HACKING PENALTIES

204.1 EXPOSURE & PUNISHMENT OF HACKERS

The User explicitly acknowledges the severe consequences for unauthorized intrusion. "Violators who hack or attempt to hack without the creator(s)'s permission will be exposed, reported, and violated (punished) by the law". The User agrees that "attempt to hack" includes probing the "Anti-Bypass Security," testing API endpoints for vulnerabilities, or attempting to inject SQL commands into the "Lyrics Retrieval" search bar. The Company reserves the right to publicize the identity of confirmed hackers to protect the broader community.

204.2 JURISDICTIONAL REPORTING STANDARDS

The User agrees that hacking incidents will be reported "once reported as the country, state, or local proximity deems necessary, lawful, constitutional, etc.". This clause ensures that the Company acts within the bounds of the User's specific legal jurisdiction while enforcing its security rights. The User acknowledges that cross-border cybercrimes may involve international law enforcement cooperation despite the Company's general "No Cooperation" stance regarding non-criminal user data.

SECTION CCV: PERMITTED PURPOSE & HARM PREVENTION

205.1 EDUCATIONAL & BUSINESS USE MANDATE

The User agrees to the specific scope of permitted activities: "Users may use the App for educational, creative, entertainment, informative, and business purposes". The User expressly agrees "not to harm the Company, the Creator(s), the Employee(s), etc.". Harm is defined to include reputational damage via defamation, financial damage via chargeback fraud, or technical damage via DDoS attacks. Any use outside these permitted categories renders the User's license void ab initio.

205.2 HUMAN RESOURCES & DATA LAW COMPLIANCE

The Company asserts that "All Human Resource laws are followed" regarding its internal operations. Furthermore, the User acknowledges that "all data laws, science, technology, research, industry tools, comparisons, etc., are not meant to harm but to educate, inform, entertain, create research, etc.". The User agrees that the "Industry Insights" and "Market Research" tools are provided in good faith to advance the User's career and should not be weaponized to attack competitors or manipulate market data.

SECTION CCVI: CREATOR ACCESS AND SECURITY OVERSIGHT

206.1 REMOTE ACCESS FOR SECURITY MONITORING

The Creator(s) will monitor security and remotely access User accounts with User permission unless the User violates Company policy. In cases of suspected hacking, user data breach, or extreme harassment, the Company reserves the right to access accounts to secure the platform without prior consent. This automated enforcement protocol is necessary for maintaining the security of the ecosystem. Such access shall be conducted in accordance with applicable privacy laws and limited to the scope necessary to address the security concern.

206.2 SUBSCRIPTION GATING AND LOGIN SECURITY

The Creator(s) may access the platform with a sign-in and use subscription-based features with a subscription. Access to premium features including "4K Render" and "AI Vocal Isolation" is contingent upon maintaining an active paid subscription and valid account credentials. The User is responsible for safeguarding their login credentials and maintaining compliance with payment obligations. Unauthorized access or credential sharing may result in account suspension or termination.

SECTION CCVII: CREATOR AUTHORITY AND OWNERSHIP STRUCTURE

207.1 CREATOR SOVEREIGNTY AND AMENDMENT RIGHTS

The Creator(s) is the only one who can and does make amendments to this Agreement and the App's functionality. The Creator(s) owns the App and Company and maintains exclusive authority over all aspects of the Service. Material changes to this Agreement shall be communicated to Users via email or in-app notification. Continued use of the Service after notification constitutes the User's acceptance of the amended terms.

207.2 EXCLUSIVE ADMIN ACCESS

No one but the Admin is allowed to access the Admin account and any account permissions. Administrative access is restricted exclusively to the Creator(s) and authorized personnel designated by the Creator(s). No other person or party is allowed to access user apps in an administrative capacity without express authorization from the Creator(s). The Creator(s) maintains ownership of the App and features, and User accounts are licensed access points subject to the terms of this Agreement.

SECTION CCVIII: CLOUD STORAGE SEGREGATION & PRIVACY

208.1 FOLDER-SPECIFIC ACCESS PROTOCOLS

The Company provides a strict guarantee regarding cloud interactions: "✓ IMPORTANT: We ONLY access the SpectroModel folder in your cloud storage". The User acknowledges that the API tokens granted to the App are scoped specifically to this directory. The User agrees that the Company "NEVER access[es] your personal files, photos, documents, or any other folders" residing in the connected Google Drive, Dropbox, or OneDrive account. This "User Data Isolated" approach ensures that the User’s broader digital life remains private.

208.2 RIGHT TO REVOKE ACCESS

The User retains full control over this connection. The User acknowledges the right to "revoke access anytime through your cloud provider's settings". The User agrees that exercising this right is the definitive method for terminating the App's ability to save data. The Company is not liable for data that cannot be written to the cloud after access is revoked.

SECTION CCIX: VOLATILE MEMORY & TEMPORARY BUFFERING

209.1 NO PERMANENT AUDIO STORAGE

The User acknowledges the "Cloud-First" security architecture stating: "☁️ CLOUD STORAGE: Raw audio files are NOT permanently stored ANYWHERE" on SpectroModel servers. The User agrees that the App operates as a processing engine, not a data warehouse. Any audio uploaded for "Track Analysis" or "Source Separation" exists only in the server's Random Access Memory (RAM) for the duration of the calculation.

209.2 AUTOMATED BUFFER CLEARANCE

The Company warrants that "After processing (30-60 seconds), the audio buffer is cleared from memory". The User accepts that this is an automated, irreversible garbage collection process. The User agrees that "Only analysis results (JSON data) are saved to YOUR cloud account". The Company servers "NEVER store your audio or analysis data" beyond this brief processing window, ensuring that in the event of a server seizure or breach, no user audio files exist to be compromised.

SECTION CCX: CRITICAL INTERPRETATION & NOMENCLATURE

210.1 CASE INSENSITIVITY CLAUSE

The User acknowledges the "CRITICAL INTERPRETATION NOTICE" regarding nomenclature. For the purposes of this Agreement, the terms "Creator(s)", "creator(s)", "Company", "company", "Owner(s)", "owner(s)", "Employee(s)", "employee(s)", "SpectroModel ENT", "SpectroModel", "spectromodel", "Company's Creator(s)", "company's creator(s)", and any other variation in capitalization, spacing, or casing "SHALL BE INTERPRETED AS SYNONYMOUS". The User agrees that the "intent and legal weight of the statement remain unchanged regardless of typographic variation".

210.2 ANTI-EXPLOITATION OF AMBIGUITY

The User explicitly agrees that "English language ambiguity shall not be exploited to void these terms". The User waives the right to argue that a capitalization error or minor typo invalidates a clause regarding "Intellectual Property" or "Liability." The definitions provided by the Creator(s) are final and binding.

SECTION CCXI: INTELLECTUAL PROPERTY & AUTOMATED ENFORCEMENT

211.1 EXCLUSIVE OWNERSHIP MANDATE

The User agrees to the overarching mandate: "COMPANY OWNS ALL COMPANY'S INTELLECTUAL PROPERTY". This includes, but is not limited to, the "App, its source code, algorithms (including but not limited to Hip Hop 80s/90s detection logic, Pop Hit Score calculators, DSP engines, AI training datasets, and VibeVision™ technology)". The User acknowledges that these assets are "patented, trademarked, and copyrighted under international law".

211.2 PROHIBITION OF THEFT & REPLICATION

The User is strictly prohibited from attempting to "use, steal, replicate, or distribute the name 'SpectroModel' or any associated assets without the Owner(s)'s and Creator(s)'s expressed written consent". The User acknowledges that the "Automated enforcement active" status means that the App actively scans for unauthorized cloning or API scraping attempts and will automatically block offending IP addresses.

SECTION CCXII: TRADEMARK SOVEREIGNTY & BRAND ASSETS

212.1 VIBEVISION™ & SPECTROMODEL™ PROTECTION

The User acknowledges that "SpectroModel™ and VibeVision™ are registered trademarks of SpectroModel ENT.". The User agrees that these marks represent the goodwill and reputation of the Company. Any unauthorized use of these terms in meta-tags, hidden text, or ad-word triggers is strictly prohibited. SECTION CCXXXIX: GOOGLE ADS COMPLIANCE, ADVERTISING DATA & MARKET RESEARCH

The User acknowledges that the Company utilizes Google Ads (formerly Google AdWords) and related Google advertising services to promote the SpectroModel platform. By accessing or using the Service, the User consents to the data collection practices described herein, which are conducted in full compliance with the Google Ads Terms of Service, the Google Ads Data Processing Terms, the Google Privacy Policy, and all applicable Google advertising policies. The Company incorporates by reference the following Google policies: (a) Google Ads Personalized Advertising Policy; (b) Google EU User Consent Policy; (c) Google Ads Misrepresentation Policy; (d) Google Ads Data Collection and Use Policy; (e) Google Ads Remarketing Policy; and (f) Google Analytics Terms of Service. The User agrees that these policies, as amended by Google from time to time, apply to the advertising-related data collection practices of the Service.

239.0.2 ADVERTISING DATA COLLECTION & PURPOSES

When the Company runs advertising campaigns through Google Ads or similar platforms, the following categories of User data may be collected, processed, and utilized: (a) Device and Browser Information: device type, operating system, browser type and version, screen resolution, and hardware identifiers; (b) Network Information: IP address, internet service provider, and approximate geographic location (city, region, country); (c) Behavioral Data: pages visited, features accessed, session duration, click patterns, scroll depth, and interaction events; (d) Conversion Data: sign-up completions, subscription purchases, feature activations, and other goal completions; (e) Advertising Identifiers: Google Advertising ID (GAID), Identifier for Advertisers (IDFA), cookie identifiers, and pixel-based tracking data. The User acknowledges that market segmentation data is processed in aggregate form and is not used to make individual decisions about Users. The Company may share anonymized, aggregated audience insights with advertising partners solely for campaign optimization purposes, in compliance with GDPR Article 6(1)(f) (legitimate interests) and CCPA requirements.

239.0.4 COOKIES, TRACKING TECHNOLOGIES & USER CONSENT

The Service and its advertising partners use cookies, web beacons, pixels, local storage, and similar tracking technologies to facilitate advertising delivery and measurement. The User acknowledges the following categories of advertising-related cookies: (a) Essential Advertising Cookies: required for basic ad serving and fraud prevention; (b) Performance Cookies: used to measure advertising campaign performance, including Google Analytics cookies (_ga, _gid, _gat); (c) Targeting Cookies: used for remarketing and interest-based advertising, including Google Ads cookies (IDE, ANID, NID); (d) Social Media Cookies: used when Users interact with social sharing features. For Users in the European Economic Area (EEA), the United Kingdom, and other jurisdictions requiring affirmative consent, the Company implements a consent management platform in compliance with the Google EU User Consent Policy, the ePrivacy Directive (Directive 2002/58/EC), and GDPR Article 7. Users may manage their cookie preferences at any time through the Service's cookie settings, their browser settings, or the following opt-out mechanisms: Google Ads Settings (adssettings.google.com), Digital Advertising Alliance (optout.aboutads.info), Network Advertising Initiative (optout.networkadvertising.org), and European Interactive Digital Advertising Alliance (youronlinechoices.eu).

239.0.5 REMARKETING, RETARGETING & SIMILAR AUDIENCES

The Company may use Google Ads Remarketing and Similar Audiences features to display targeted advertisements to Users who have previously visited or interacted with the Service. The User acknowledges that: (a) remarketing lists are created based on User interactions with the Service, such as pages visited, features used, and subscription status; (b) the Company does not include Users in remarketing lists based on sensitive categories as defined by Google Ads policies; (c) remarketing advertisements may appear across the Google Display Network, Google Search Network, YouTube, and partner websites; (d) the User may opt out of remarketing at any time through their Google Ads Settings or by clearing their browser cookies; (e) the Company adheres to minimum list sizes and frequency caps as required by Google Ads policies to protect User privacy.

239.0.6 CROSS-PLATFORM & CROSS-DEVICE ADVERTISING COMPATIBILITY

All advertising technologies and data collection practices implemented by the Company are optimized for full compatibility across the following environments: Desktop Operating Systems (Windows 10/11, macOS 12+, Linux distributions including Ubuntu 20.04+ and Fedora 35+); Mobile Operating Systems (iOS 15+ on iPhone and iPad, Android 11+ on all devices); Tablet Devices (iPad with iPadOS 15+, Android tablets, Microsoft Surface); Web Browsers (Google Chrome 100+, Mozilla Firefox 100+, Apple Safari 15+, Microsoft Edge 100+, Opera 90+, Brave, Vivaldi, Samsung Internet, and all Chromium-based browsers); and Web Views (in-app browsers on iOS and Android). The Company ensures that advertising consent mechanisms, opt-out controls, and privacy settings function correctly across all supported platforms, browsers, and device types. Screen sizes from 320px (small mobile) to 8K displays are supported with no horizontal overflow or layout issues in advertising consent interfaces.

239.0.7 DATA RETENTION FOR ADVERTISING PURPOSES

Advertising-related data is retained for the following periods: (a) Campaign Performance Data: retained for up to thirty-six (36) months for longitudinal performance analysis; (b) Conversion Data: retained for up to twenty-four (24) months for attribution modeling; (c) Remarketing Lists: retained for up to five hundred forty (540) days as permitted by Google Ads policies; (d) Aggregated Analytics Data: retained indefinitely in anonymized form for market research purposes. The User has the right to request the deletion of their advertising-related personal data at any time, subject to the Company's legitimate retention needs and legal obligations. Deletion requests are processed within thirty (30) days in accordance with GDPR Article 17 (Right to Erasure) and CCPA Section 1798.105.

239.0.8 PROHIBITED ADVERTISING PRACTICES

The Company commits to the following advertising standards: (a) the Company shall not engage in misleading or deceptive advertising practices; (b) the Company shall not use sensitive personal data categories for advertising targeting; (c) the Company shall not collect data from Users under the age of thirteen (13) for advertising purposes, in compliance with COPPA; (d) the Company shall not serve personalized advertisements to Users who have opted out of personalized advertising; (e) the Company shall prominently disclose all material connections and sponsorships in advertising content; (f) the Company shall ensure all landing pages accurately represent the Service and do not redirect Users to unexpected destinations, in compliance with the Google Ads Destination Requirements Policy and the Google Ads Misrepresentation Policy; (g) the Company shall maintain transparent pricing and shall not employ bait-and-switch tactics in advertising creative.

SECTION CCXL: FINAL ACKNOWLEDGEMENT & EXECUTION

240.1 BINDING AGREEMENT

By clicking "I Agree," accessing the Dashboard, or uploading any file to SpectroModel, the User acknowledges that they have read, understood, and agree to be bound by this Master Service Agreement, the Privacy Policy, and all associated intellectual property declarations.

240.2 DIGITAL SIGNATURE

I acknowledge that I have read, understood, and agree to be bound by these Terms of Service and Privacy Policy. I understand that my action here constitutes a legal signature recorded by the system.
